BUYER

The Buyer is the individual or legal entity whose name, delivery address, billing address, contact information, and other details are entered during checkout and shown in the order confirmation.

  1. SCOPE

This Agreement governs the distance sale and delivery of products ordered by the Buyer through zenfaden.store.

The product page, shopping cart, checkout page, order summary, order confirmation, Return and Refund Policy, Shipping Policy, Privacy Policy, and Terms of Service form an integral part of this Agreement.

  1. PRE-CONTRACT INFORMATION

Before placing an order, the Buyer is informed about:

  • The essential characteristics of the products

  • The identity and contact details of the Seller

  • The total price, taxes, shipping charges, and any disclosed additional costs

  • Payment and delivery methods

  • Estimated processing and delivery times

  • Cancellation, return, and withdrawal rights

  • Applicable exceptions to the right of withdrawal

  • Complaint and customer-support procedures

By completing checkout, the Buyer confirms that this information has been reviewed and that the order creates a payment obligation.

  1. PRODUCTS, PRICES, AND ORDERS

The products, quantities, variants, prices, discounts, taxes, shipping charges, and total payable amount are those displayed in the Buyer’s checkout and order confirmation.

Prices may be displayed in the currency selected for the Buyer’s market. Orders are subject to payment approval, product availability, fraud checks, delivery restrictions, and applicable law.

If a paid order cannot be fulfilled, the Seller will notify the Buyer and issue an appropriate refund through the original payment method.

  1. PAYMENT

Payment is processed through the payment method selected during checkout and may be handled by an independent payment service provider.

The Buyer is responsible for providing accurate payment, billing, and contact information. The Seller does not directly store complete credit or debit card information.

  1. DELIVERY

Products may be processed and shipped by independent suppliers, warehouses, and fulfillment partners in different countries. Items within the same order may arrive in separate packages.

The order will be delivered to the address provided by the Buyer within the estimated period displayed on the product page, at checkout, or in the order confirmation. Where no different period has been expressly agreed, delivery will be completed within the maximum period required by applicable law.

For consumers protected by Turkish distance-sales law, products will generally be sent no later than 30 days unless a longer period is lawfully agreed for customized or specially produced goods.

The Seller remains responsible for loss or damage until delivery to the Buyer or a person designated by the Buyer, except where applicable law provides otherwise.

  1. RIGHT OF WITHDRAWAL

Unless a statutory exception applies, eligible consumers may withdraw from the Agreement within 14 days without providing a reason and without paying a penalty.

For goods, the withdrawal period generally begins on the date the Buyer or a person designated by the Buyer receives the product. If products in one order are delivered separately, the period begins when the final eligible item is delivered, where required by applicable law.

The Buyer may also send a withdrawal request before delivery.

To exercise the right of withdrawal, the Buyer must provide a clear written statement by email to zenfaden@zenfaden.com, including the order number and the product to be returned.

  1. RETURN PROCEDURE AND REFUNDS

After receiving a withdrawal or return request, the Seller will provide the correct return address, instructions, and, where applicable, a return label.

Because products may ship from different fulfillment locations, the Buyer must not return a product to the Seller’s registered office or another address without receiving return instructions.

The Buyer must send the product within 14 days after notifying the Seller of the withdrawal, unless applicable law provides otherwise.

Eligible refunds will be issued through the original payment method within the period required by applicable law. Where Turkish consumer law applies, the refund period will be calculated according to the date the Buyer delivers the goods to the instructed carrier or provides valid proof of shipment.

Standard outbound delivery charges will be refunded where required by law. Additional charges resulting from an express or premium delivery method selected by the Buyer may be excluded to the extent permitted by law.

  1. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

Unless applicable law provides otherwise, the right of withdrawal may not apply to:

  • Products prepared according to the Buyer’s personal specifications

  • Perishable goods or products with a short expiration date

  • Sealed hygiene or personal-care products whose seal has been opened

  • Products that become inseparably mixed with other goods after delivery

  • Activated digital content, software, or services supplied with the Buyer’s prior consent where the withdrawal right has lawfully ended

  • Gift cards or similar instruments where legally excluded

  • Other products or services expressly excluded under applicable consumer law

A product is not automatically excluded from withdrawal merely because it was sold at a discount.

  1. DAMAGED, DEFECTIVE, OR INCORRECT PRODUCTS

The Buyer should contact zenfaden@zenfaden.com as soon as reasonably possible if a product is damaged, defective, incomplete, or different from the order.

The Seller may request photographs, videos, packaging images, or other reasonable evidence. Statutory rights relating to defective goods, replacement, repair, price reduction, or refund remain unaffected.

  1. CUSTOMS AND IMPORT CHARGES

International orders may be subject to customs duties, import taxes, or handling charges imposed by the destination country.

Any known charges collected by the Seller will be displayed during checkout. Charges not collected at checkout may be payable by the recipient where this has been disclosed and applicable law permits.

Electronic records, order confirmations, payment records, emails, tracking information, and legally valid commercial records may be used as evidence, subject to applicable law.

  1. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement is governed by the laws of the Republic of Türkiye, without excluding mandatory consumer protections available in the Buyer’s country of residence.

Eligible consumers may apply to the competent consumer arbitration committee, consumer court, court, or alternative dispute-resolution body available under applicable law.

  1. EFFECTIVENESS

This Agreement becomes effective when the Buyer completes the order and accepts the contractual information presented at checkout.

The order confirmation sent electronically to the Buyer forms part of this Agreement.

ALICI

Alıcı; ödeme aşamasında adı, teslimat ve fatura adresi, iletişim bilgileri ile diğer bilgileri girilen ve sipariş onayında belirtilen gerçek veya tüzel kişidir.

  1. SÖZLEŞMENİN KONUSU

Bu Sözleşme, Alıcının zenfaden.store üzerinden elektronik ortamda sipariş verdiği ürünlerin mesafeli satışı ve teslimine ilişkin tarafların hak ve yükümlülüklerini düzenler.

Ürün sayfası, sepet, ödeme ekranı, sipariş özeti, sipariş onayı, İade ve Para İadesi Politikası, Kargo Politikası, Gizlilik Politikası ve Hizmet Şartları bu Sözleşmenin ayrılmaz parçalarıdır.

  1. ÖN BİLGİLENDİRME

Alıcı, siparişi tamamlamadan önce aşağıdaki konularda bilgilendirildiğini kabul eder:

  • Ürünlerin temel nitelikleri

  • Satıcının kimliği ve iletişim bilgileri

  • Vergiler dâhil toplam fiyat

  • Kargo ve varsa ek masraflar

  • Ödeme ve teslimat yöntemleri

  • Tahminî hazırlık ve teslimat süreleri

  • İptal, iade ve cayma hakkı

  • Cayma hakkının istisnaları

  • Talep ve şikâyet yöntemleri

Alıcı, ödeme adımını tamamlayarak siparişin ödeme yükümlülüğü doğurduğunu kabul eder.

  1. ÜRÜNLER, FİYATLAR VE SİPARİŞ

Ürünlerin türü, miktarı, varyantı, fiyatı, indirimi, vergileri, kargo ücreti ve toplam sipariş bedeli ödeme ekranı ile sipariş onayında gösterildiği gibidir.

Sipariş; ödemenin onaylanması, ürünün mevcut olması, güvenlik kontrolleri, teslimat kısıtlamaları ve yürürlükteki mevzuata tabidir.

Ücretli bir siparişin yerine getirilememesi hâlinde Alıcı bilgilendirilir ve uygun bedel iadesi kullanılan ödeme yöntemine yapılır.

  1. ÖDEME

Ödeme, Alıcının ödeme aşamasında seçtiği yöntemle ve bağımsız bir ödeme hizmeti sağlayıcısı aracılığıyla gerçekleştirilebilir.

Alıcı, ödeme, fatura ve iletişim bilgilerinin doğru olduğunu kabul eder. Satıcı, banka veya kredi kartının tam bilgilerini doğrudan saklamaz.

  1. TESLİMAT

Ürünler, farklı ülkelerde bulunan bağımsız tedarikçiler, depolar ve sipariş karşılama ortakları tarafından hazırlanıp gönderilebilir. Aynı siparişteki ürünler ayrı paketlerle teslim edilebilir.

Teslimat, ürün sayfasında, ödeme ekranında veya sipariş onayında belirtilen tahminî süre içinde Alıcının bildirdiği adrese yapılır.

Ayrıca farklı bir süre açıkça kararlaştırılmadıkça ürün, yürürlükteki mevzuatta belirlenen azami süre içinde gönderilir. Türkiye’deki mesafeli satış mevzuatının uygulandığı tüketici işlemlerinde, kişiye özel ürünler için hukuken daha uzun bir süre kararlaştırılmadıkça ürün en geç 30 gün içinde gönderilir.

Ürün, Alıcıya veya Alıcının belirlediği üçüncü kişiye teslim edilinceye kadar oluşabilecek kayıp ve hasardan, mevzuatta aksi öngörülmedikçe, Satıcı sorumludur.

  1. CAYMA HAKKI

Kanuni bir istisna bulunmadıkça tüketici niteliğindeki Alıcı, 14 gün içinde herhangi bir gerekçe göstermeden ve cezai şart ödemeden sözleşmeden cayabilir.

Mal satışlarında süre, Alıcının veya Alıcının belirlediği üçüncü kişinin ürünü teslim aldığı gün başlar. Tek sipariş kapsamındaki ürünlerin ayrı günlerde teslim edilmesi hâlinde, mevzuatın gerektirdiği durumlarda süre son ürünün teslim edildiği gün başlar.

Alıcı, ürün teslim edilmeden önce de cayma bildiriminde bulunabilir.

Cayma bildirimi; sipariş numarası ve iade edilecek ürün belirtilerek zenfaden@zenfaden.com adresine yazılı şekilde gönderilmelidir.

  1. İADE SÜRECİ VE BEDEL İADESİ

Cayma veya iade talebi alındığında Satıcı, doğru iade adresini, talimatları ve gerektiğinde iade etiketini Alıcıya bildirir.

Ürünler farklı sipariş karşılama noktalarından gönderilebildiği için Alıcı, kendisine talimat verilmeden ürünü şirketin kayıtlı adresine veya başka bir adrese göndermemelidir.

Alıcı, cayma bildiriminden itibaren 14 gün içinde ürünü belirtilen şekilde geri göndermelidir.

Onaylanan iadeler, yürürlükteki mevzuatta öngörülen süre içinde ve satın almada kullanılan ödeme aracına uygun biçimde yapılır. Türkiye tüketici mevzuatının uygulandığı durumlarda süre, ürünün belirtilen taşıyıcıya teslim edildiği veya geçerli gönderim kanıtının sunulduğu tarihe göre hesaplanır.

Kanunen gerekli olduğu durumlarda standart ilk teslimat masrafı da iade edilir. Alıcının özellikle seçtiği ekspres veya standarttan daha pahalı teslimat seçeneğine ilişkin ek ücretler, mevzuatın izin verdiği ölçüde iade dışında tutulabilir.

  1. CAYMA HAKKININ İSTİSNALARI

Yürürlükteki mevzuatta aksi öngörülmedikçe cayma hakkı aşağıdaki ürün ve hizmetlerde kullanılamayabilir:

  • Alıcının kişisel isteklerine göre hazırlanan ürünler

  • Çabuk bozulabilen veya son kullanma tarihi geçebilecek ürünler

  • Koruyucu ambalajı açılmış ve hijyen açısından iadesi uygun olmayan ürünler

  • Teslimden sonra başka ürünlerle ayrılmaz biçimde karışan ürünler

  • Alıcının önceden onayıyla sunulan ve cayma hakkının hukuken sona erdiği dijital içerikler veya yazılımlar

  • Kanunen kapsam dışında bırakılan hediye kartları

  • Mevzuatta açıkça istisna sayılan diğer ürün ve hizmetler

Bir ürünün indirimli olması tek başına cayma hakkını ortadan kaldırmaz.

  1. HASARLI, AYIPLI VEYA YANLIŞ ÜRÜN

Ürünün hasarlı, ayıplı, eksik veya sipariş edilenden farklı olması durumunda Alıcı, makul olan en kısa sürede zenfaden@zenfaden.com adresine başvurmalıdır.

Satıcı fotoğraf, video, ambalaj görüntüsü veya başka makul kanıtlar isteyebilir. Alıcının ayıplı mala ilişkin onarım, değişim, bedel indirimi ve bedel iadesi gibi kanuni hakları saklıdır.

  1. GÜMRÜK VE İTHALAT MASRAFLARI

Uluslararası siparişlerde varış ülkesi tarafından gümrük vergisi, ithalat vergisi veya işlem masrafı uygulanabilir.

Satıcı tarafından tahsil edilen bilinen masraflar ödeme aşamasında gösterilir. Ödeme sırasında tahsil edilmeyen masraflar, önceden açıklanmış olması ve mevzuatın izin vermesi koşuluyla alıcıya ait olabilir.

Elektronik kayıtlar, sipariş onayları, ödeme kayıtları, e-postalar, takip bilgileri ve hukuken geçerli ticari kayıtlar yürürlükteki mevzuata uygun biçimde delil olarak kullanılabilir.

  1. UYGULANACAK HUKUK VE UYUŞMAZLIKLAR

Bu Sözleşmeye Türkiye Cumhuriyeti hukuku uygulanır. Alıcının ikamet ettiği ülkedeki emredici tüketici hakları saklıdır.

Tüketici niteliğindeki Alıcı, mevzuata göre yetkili Tüketici Hakem Heyetine, Tüketici Mahkemesine veya kendisine tanınan diğer uyuşmazlık çözüm mercilerine başvurabilir.

  1. YÜRÜRLÜK

Bu Sözleşme, Alıcının ödeme ekranında sunulan bilgileri kabul edip siparişi tamamlamasıyla yürürlüğe girer.

Alıcıya elektronik ortamda iletilen sipariş onayı bu Sözleşmenin ayrılmaz parçasıdır.
